This Privacy Policy describes how Kessler Foundation Inc. collects and uses personal information about you through the use of our KF-STRIDE® Strength Identification and Expression in Young Adults research study internet-accessible service and mobile application, and through email, text, and other electronic communications between you and Kessler Foundation Inc. in connection with this service and mobile application (the service and mobile application are individually and collectively referred to herein as, the “Application“).

Kessler Foundation Inc. (“Company,” “We,” “Our,” or “Us”) respect your privacy and are committed to protecting it through our compliance with this policy (“Privacy Policy”). This Privacy Policy describes: 

  • The types of information we may collect or that you may provide when you download, access, or use the Application (“Personal Information”).
  • Our practices for collecting, using, maintaining, protecting, and disclosing that information.

This Privacy Policy applies only to information we collect during your use of the Application.

This Privacy Policy DOES NOT apply to information that:

  • We collect offline or through any other means, including on any other applications or websites operated by Us or any third party; 
  • Any third party, including through any application or content that may link to or be accessible from the Application; and
  • You provide to or is collected by any third party.

Our websites and other apps, and other third parties may have their own privacy policies, which we encourage you to read such privacy policies before providing information on or through them.

By downloading, registering with, or using the Application, you hereby agree to this Privacy Policy. Children Under the Age of 13

The Application is not intended for children under 13 years of age, and children under the age of 13 are not permitted to use Our Application. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on our Application on or through any of their features, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. Individuals Between the Ages 13 and 17

The Application may be used by between individuals between the ages of 13 and 17 with approval from their parent or guardian provided through the Application. We may ask you to represent that your parent or guardian properly provided their approval, and/or we may ask you to provide an email or postal address of your parent or guardian so we may contact them to confirm their approval. Once we receive your representation of parent or guardian approval and/or when we receive the parent or guardian confirmation of approval, the associated 13 to 17 year old’s account will be created and such individual can use the Application.

Information We Collect About You and How We Collect It

We collect different types of information about you, including information that may directly identify you, such as health information and information about traffic data, location data, logs, other communication data, information about your mobile device, and the resources that you access and use on the Application. We also collect information that is about you but individually does not personally identify you, and information that We combine with Our other users. This includes information that We collect directly from you or through automated collection technologies We collect information from and about users of Our Application. Also, as you navigate through and interact with our Application, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, specifically details of your visits to our Application, such as traffic data, location, logs, information about your mobile device, other communication data, and the resources that you access and use on the Application.

Information You Provide to Us  

When you download, register with, or use the Application, we may ask you to provide certain information:

  • By which you may be personally identified, such as name, email address, any other identifier by which you may be contacted online or by telephone or mail.
  • That is about you but individually does not identify you, such as your username.

This information includes: 

  • Information that you provide by filling in forms in the Application including at the information provided at the time of registering to use the Application, or when requesting further Application. We may also ask you for information when you report a problem with the Application.
  • Records and copies of your correspondence (including email addresses and phone numbers), if you contact us.
  • Your responses to questions, requests for information or surveys that We might ask you to complete for assignments and/or research purposes.
  • Other types of information you may provide in completing assignments.  Importantly, if there is Personal Information or other information you do not wish Us to possess or see, you should not include or link to such information as part of your assignments or provide Us using other means.

We will not collect or use and you should not provide us with any other Personal Information including any other information that is linked or linkable to an individual, such as medical, educational, financial, and employment information. Other examples of Personal Information includes personal identification numbers such as social security number, passport number, driver’s license number, taxpayer identification number, patient identification number;  personal address information such as street address or email address; personal characteristics: photographic images (particularly of face or other identifying characteristics), fingerprints, or handwriting; biometric data such as retina scans, voice signatures, or facial geometry; information identifying personally owned property such as VIN number or title number; and asset information such as Internet Protocol (IP) or Media Access Control (MAC) addresses that consistently link to a particular person. 

Automatic Information Collection 

When you download, access, and use the Application, it may use technology to automatically collect:

  • Usage Details. When you access and use the Application, we may automatically collect certain details of your access to and use of the Application.   
  • Device Information. We may collect information about your User Device and internet connection.

Information Collection Technologies 

The technologies we use for automatic information collection may include:

Cookies (or mobile cookies). A cookie is a small file placed on your smartphone. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your smartphone. However, if you select this setting you may be unable to access certain parts of our App. 

Third-Party Information Collection

When you use the Application or its content, certain third parties may use automatic information collection technologies to collect information about you or your device. These third parties may include: 

  • Your mobile device manufacturer.
  • Your mobile service provider.
  • Analytics companies.
  • Others.

These third parties may use tracking technologies to collect information about you when you use the Application. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites, apps, and other online Application websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. 

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. 

How We Use Your Information 

We may use information that we collect about you or that you provide to Us, including any Personal Information, to:

  • Provide you with the Application and its contents, and any other information, products or services that you request from Us.
  • Fulfill any other purpose for which you provide it.
  • Give you notices about your account.
  • Carry out Our obligations and enforce Our rights arising from any contracts entered into between you and Us.
  • Notify you when Application updates are available, and of changes to any products or services we offer or provide though it.
  • In any other way We may describe when you provide the information.
  • For any other purpose with your consent.

The usage information We collect helps Us to improve our Application and to deliver a better and more personalized experience by enabling us to:

  • Estimate Our audience size and usage patterns.
  • Store information about your preferences, allowing Us to customize Our Application according to your individual interests.
  • Recognize you when you use the Application.

Disclosure of Your Information

We may disclose aggregated information about Our users, and information that does not identify any individual or device, without restriction. 

In addition, We may disclose personal information that We collect or you provide:

  • To contractors, service providers, and other third parties We use to support Our business.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Kessler Foundation Inc. assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by Kessler Foundation Inc. about our Application is among the assets transferred.
  • To fulfill the purpose for which you provide it. 
  • For any other purpose disclosed by Us when you provide the information.
  • With your consent.
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce Our rights arising from any contracts entered into between you and Us, including the associated End User License Agreement(s) for these Application.
  • If We believe disclosure is necessary or appropriate to protect the rights, property, or safety of Kessler Foundation Inc. or others. 

Your Choices About Our Collection, Use, and Disclosure of Your Information

We strive to provide you with choices regarding the Personal Information you provide to Us. This section describes mechanisms we provide for you to control certain uses and disclosures of your information. 

  • Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the Application may then be inaccessible or not function properly.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI“) on the NAI’s website.

Accessing and Correcting Your Personal Information

You can review and change your Personal Information by logging into the Application and visiting your account profile page.

Data Security

We are committed to taking reasonable efforts to secure the information that you choose to provide us, and we use a variety of security procedures to help protect against unauthorized access to or alteration, disclosure, or destruction of Personal Information. We restrict access to Personal Information to our employees, volunteers, contractors, and vendors who need to know the information to operate, develop, or improve our services.

The safety and security of your information also depends on you. Where We have given you (or where you have chosen) a password for access to certain parts of Our Application, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. 

Unfortunately, no transmission of Personal Information over the Internet can be guaranteed to be 100% secure.  Accordingly, and despite our efforts, We cannot guarantee or warrant the security of any information you transmit to Us, or to or from our Application. We have no responsibility or liability for the security of information transmitted via the Internet.
